Terms of Service

1. Acceptance of Terms

By requesting, scheduling, or receiving any service from Sam's Roadside Service, LLC ("Company," "we," "us," or "our"), whether through our website (samsroadsideservice.com), booking platform (samsroadsidebooking.com), telephone, text message, third-party dispatch, or any other method, you ("Customer," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, do not request or use our services.

We reserve the right to update or modify these Terms at any time. Changes take effect upon posting to our website. Continued use of our services after changes constitutes acceptance of the revised Terms.

2. Services Provided

Sam's Roadside Service provides mobile automotive services in the Indianapolis, Indiana metropolitan area, including but not limited to:

  • Mobile tire replacement and repair
  • Mobile battery testing, sales, and installation
  • Jump-start service
  • Lockout assistance
  • Fuel delivery
  • Minor roadside assistance and related services

Service availability is subject to technician availability, geographic coverage, weather conditions, and other operational factors. We reserve the right to decline any service request at our sole discretion.

3. Booking & Scheduling

3.1 Service Requests

Service requests may be placed through our website, booking platform, telephone, or text message. A service request is not confirmed until you receive a confirmation from our team with a technician assignment and estimated time of arrival (ETA). All ETAs are estimates only and are not guaranteed.

3.2 Pricing & Payment Authorization

Service pricing is quoted at the time of booking based on the information you provide. By confirming a service request, you authorize us to charge your payment method for the quoted amount plus any applicable taxes and fees. You acknowledge that:

  • Quoted prices are based on the service description you provide. If actual conditions differ materially from what was described (e.g., different tire size, additional services needed, vehicle in an unsafe or inaccessible location), the final price may be adjusted.
  • A payment authorization hold may be placed on your card at the time of booking. This hold may temporarily reduce your available balance.
  • Final charges are processed upon completion of service.

3.3 Accurate Information

You agree to provide accurate and complete information when requesting service, including but not limited to: vehicle year, make, model, location, nature of the problem, and any hazards or access restrictions. Inaccurate or incomplete information may result in service delays, additional charges, or cancellation.

3.4 SMS & Text Message Communications

By providing your phone number when booking a service or contacting us, you expressly consent to receive SMS text messages from Sam's Roadside Service, LLC. These messages may include:

  • Transactional messages: Booking confirmations, service updates, driver ETA notifications, job claim alerts, and payment receipts.
  • Promotional messages: Special offers, service reminders, and company updates.

Message frequency: Message frequency varies based on your service activity. You will typically receive 1–5 messages per service interaction. Promotional messages are sent no more than 4 times per month.

Opt-out: You may opt out of receiving text messages at any time by replying STOP to any message. After opting out, you will receive a one-time confirmation message. You may still receive transactional messages related to active service requests.

Message and data rates: Standard message and data rates from your wireless carrier may apply. Check with your carrier for details.

Consent is not required for purchase. You are not required to consent to receive text messages as a condition of purchasing any goods or services. Carriers are not liable for delayed or undelivered messages.

4. Cancellation Policy

We understand that plans change. Our cancellation policy is designed to be fair while accounting for the time, fuel, and resources our technicians commit when dispatched. The following cancellation tiers apply:

Company-Initiated Cancellations: If we cancel a service request due to technician unavailability, unsafe conditions, or other operational reasons before arriving on scene, you will not be charged. If a technician is unable to complete a service after arriving on scene due to factors beyond our control (e.g., vehicle damage exceeds scope of roadside service, unsafe location), you may be charged a trip fee at our discretion.

5. Refund Policy

5.1 General Refund Policy

Refunds are evaluated on a case-by-case basis. You may be eligible for a full or partial refund in the following circumstances:

  • Service Not Rendered: If we are unable to perform the requested service for any reason attributable to us (e.g., wrong parts, technician error, mechanical failure of our equipment), you will receive a full refund.
  • Incomplete Service: If a service is only partially completed due to factors attributable to us, you may receive a partial refund proportional to the work not completed.
  • Defective Parts: If a part we install is found to be defective within the applicable warranty period, we will replace the part at no charge. See our Battery Warranty Policy for battery-specific terms.

5.2 Non-Refundable Charges

The following charges are non-refundable:

  • Services that have been fully completed as described
  • Dispatch fees for post-dispatch cancellations (see Section 4)
  • No-show / Gone on Arrival fees
  • Services declined after technician has arrived and begun assessment
  • Battery diagnostic service fees where the battery tests serviceable (see Battery Warranty Policy)

5.3 Refund Request Process

To request a refund, you must contact us within 48 hours of service completion. Refund requests may be submitted by:

  • Phone or text to the number on your service confirmation
  • Email to the address listed on samsroadsideservice.com
  • Through the contact form on our website

We will review your request and respond within 3 business days. Approved refunds will be issued to the original payment method within 5–10 business days.

5.4 Chargebacks & Disputes

We encourage you to contact us directly before initiating a chargeback or payment dispute with your financial institution. Filing a chargeback without first attempting resolution with us may result in suspension of your account and future service eligibility. We reserve the right to dispute any chargeback we believe to be unwarranted and to provide documentation of completed services to your financial institution.

6. Payment Terms

Payment is due at the time of service unless alternative arrangements have been made in advance. We accept major credit cards, debit cards, and other payment methods as displayed at the time of booking. By providing a payment method, you represent and warrant that:

  • You are authorized to use the payment method provided
  • The information provided is accurate and current
  • You authorize us to charge the amount due, including any applicable taxes and fees

If payment fails or is declined, we reserve the right to suspend service until payment is resolved. Accounts with outstanding balances may accrue a late fee of 1.5% per month (or the maximum rate permitted by Indiana law) on amounts past due beyond 30 days.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Sam's Roadside Service, LLC, its owners, officers, employees, agents, and independent contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of revenue, loss of data, loss of use, cost of substitute goods or services, or any other intangible losses, arising out of or in connection with the use of our services, regardless of the theory of liability.

Our total aggregate liability for any claim arising from or related to our services shall not exceed the total amount you paid to us for the specific service giving rise to the claim. This limitation applies regardless of the form of action, whether in contract, tort, negligence, strict liability, or otherwise.

We are not liable for delays, service interruptions, or inability to perform services due to circumstances beyond our reasonable control, including but not limited to: severe weather, natural disasters, road closures, traffic conditions, vehicle conditions not disclosed at the time of booking, or government orders.

8. Customer Responsibilities

By requesting service, you agree to:

  • Provide accurate vehicle information and an accurate description of the problem
  • Ensure the vehicle is in a safe, legal, and accessible location for service
  • Be present at the service location or designate an authorized representative who can approve service and payment
  • Remove personal belongings and valuables from areas where the technician will be working
  • Disclose any known hazards, vehicle modifications, or conditions that may affect service delivery

9. Indemnification

You agree to indemnify, defend, and hold harmless Sam's Roadside Service, LLC, its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any inaccurate information you provide to us.

10. Dispute Resolution

10.1 Informal Resolution

Before initiating any formal dispute proceedings, you agree to contact us first and attempt to resolve the matter informally. Most concerns can be resolved quickly through direct communication. Contact us using the information on our website.

10.2 Binding Arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in Marion County, Indiana. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

10.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than arbitration, you and we each waive any right to a jury trial.

11. Warranty Disclaimer

EXCEPT AS EXPRESSLY SET FORTH IN OUR BATTERY WARRANTY POLICY OR OTHER WRITTEN WARRANTY PROVIDED AT THE TIME OF SERVICE, ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, TIMELY, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

12. Third-Party Dispatch Services

Some service requests may be received through third-party dispatch platforms (e.g., motor clubs, roadside assistance networks, insurance companies). In such cases, the terms and conditions of the third-party platform may also apply. Any conflicts between third-party terms and these Terms shall be resolved in favor of these Terms to the extent permitted. Payment for services dispatched by third parties may be handled directly between the third-party and our Company; you may be responsible for any charges not covered by the third party.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Marion County, Indiana.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

15. Entire Agreement

These Terms, together with any applicable warranty policies and service-specific terms provided at the time of booking, constitute the entire agreement between you and Sam's Roadside Service, LLC regarding your use of our services and supersede any prior agreements, communications, or understandings, whether written or oral.
